Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  1. Reflection period: the period within which the consumer can exercise his right of withdrawal;

  2. Donor: the natural person who does not act in the exercise of a profession or business and makes a donation to the foundation;

  3. Day: calendar day;

  4. Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;

  5. Durable data carrier: any means that enables the consumer or foundation to store information addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored information.

  6. Foundation: the legal person who can accept donations;

  7. Technique for distance communication: means that can be used for concluding an agreement, without the consumer and foundation being together in the same room at the same time.

  8. General Terms and Conditions: the present General Terms and Conditions of the foundation.

Article 3 – Applicability

  1. These general terms and conditions apply to every donation to the foundation.

  2. When receiving a donation, the general terms and conditions offered via the donation page apply.

  3. If one or more provisions in these general terms and conditions are wholly or partially void or annulled at any time, the agreement and these terms and conditions will remain in force for the rest and the provision in question will be replaced by mutual agreement without delay with a provision that approaches the purport of the original as closely as possible.

  4. Situations not covered by these general terms and conditions should be assessed 'in the spirit' of these general terms and conditions.

  5. Uncertainties about the interpretation or content of one or more provisions of our terms and conditions should be interpreted 'in the spirit' of these general terms and conditions.

Article 4 – Donations

  1. A donation may consist of an amount of money or a material donation towards the objectives of the foundation.

  2. A donation is at all times without obligation.

  3. In the case of a material donation, it is up to the foundation to decide how it will be used for the foundation's objectives.

  4. In the case of a monetary donation, it is up to the donor to indicate the purposes for which the donation will be used. The purposes are defined by the foundation.

  5. Should the total amount of the donation for a specific and non-general purpose exceed the total cost of this purpose, the foundation may use the funds for other general or non-general purposes.

  6. Donor has no right to return donated funds and materials.

Article 5 – Right of withdrawal for donations

  1. When giving a donation, in principle, there is no right of withdrawal.

  2. Exceptions to paragraph 1 are: In case of an accidentally wrong amount or wrong interval of donation. Donor must notify the foundation of this within 14 days after donation;

  3. If there is an unlawful act as a result of which the donation has been made, the person who is lawful can make this known to the foundation within 14 days of the donation.

Article 6 – Costs in case of revocation

  1. If there is a revocation in accordance with Article 5 with regard to a donation, the foundation may deduct any transaction and administration costs from the amount donated.

  2. The withdrawal costs are €2.50.

Article 7 – Spending of donations

  1. The foundation will take the utmost care when receiving donations.

  2. The foundation will report donations received in its annual accounts. This will also show what the amounts have been spent on.

  3. The foundation guarantees that donations are spent in accordance with the objectives.

  4. It may happen that a project-based donation is not (entirely) used for the chosen project. The foundation is free to spend the amount on another project. Spending donations must always be in line with the foundation's overall objective.

Article 8 – Transactions: duration, termination and renewal

Duration

  1. As the period donations are indefinite, the donor may stop his/her donation at any time.

Termination

  1. A periodic donation can be cancelled by the donor at any time. To do so, the donor can withdraw the direct debit from his/her bank or request the foundation by e-mail mecenaat@itg.be to stop the donation.

  2. A period of 7 days applies for cancellation. If a payment is still scheduled within 7 days, it will not be cancelled.

  3. An exception to the notice period is in the event of donor's death. If a donor dies, no more payments will be collected after the date of notification. Should this still happen, they will be returned to the deceased donor's account number as soon as possible.

Renewal

  1. In the case of a periodic donation, the amount will be charged automatically on the first day of the month within the appropriate periodicity. In case of direct debit, it will also be debited from the donor's account around this period.

  2. Donations are tacitly renewed until and unless cancelled.

Article 9 – Payment

  1. The consumer has the duty to immediately report inaccuracies in payment data provided or mentioned to the foundation.

Article 10 – Complaints procedure

  1. In the event of a complaint about a donation, the donor must make this known within 2 months of the legal act by sending an e-mail to complaints@itg.be.

  2. Complaints will be dealt with by the Quality Service within 6 weeks of receipt.

  3. The complainant will receive by e-mail and post the response to and assessment of the complaint.

  4. If the complaint cannot be resolved by mutual agreement, a dispute arises which is susceptible to the dispute settlement procedure.

  5. In case of complaints, a donor should first turn to the foundation.

  6. A complaint does not suspend the foundation's obligations, unless the foundation indicates otherwise in writing.

  7. If a complaint is found well-founded by the foundation, the foundation will, at its discretion, offer a solution to resolve the dispute.

Article 11 – Disputes

  1. Donations between the foundation and the donor to which these general terms and conditions relate are governed exclusively by Belgian law., even if the donor resides abroad.
